Terms of Service

These terms are an agreement between you and AXONFLOW INNOVATIONS PRIVATE LIMITED, doing business as InterviewFlowAI ("we", "us"), for your use of Talking Avatar: the website talking-avatar.dev, the dashboard at app.talking-avatar.dev, the Realistic Avatars API and SDK, and the live demo (together, the "Service"). By creating an account or using the Service, you accept these terms. If you use the Service for a company, you accept them for that company and confirm you may do so.

You must be at least 18 years old to use the Service.

Talking Avatar gives voice agents a realistic face: your application sends speech audio, and an avatar speaks it in real time, streamed to your users. Each session can last up to 3 hours. We may add, change or remove avatars and features, and will give reasonable notice before removing something you rely on.

Our open-source lip-sync SDK is licensed separately under the MIT License, which governs its use. These terms cover your use of our hosted Service.

• Give accurate information and keep your account's email address up to date.
• Keep your API keys secret and use them only on your servers, never in a browser or app your users can inspect. You are responsible for all usage on your keys. Delete a key in the dashboard straight away if it may have been exposed, and tell us at support@interviewflowai.com.
• Members of your account share its balance, keys and usage.

• Price. Avatar sessions cost $0.02 per minute, billed per second, from the moment the avatar is live until the session ends. We may change prices with at least 30 days' notice; changes don't affect credits already used.
• Prepaid credits. You add credits to your account in advance and usage is deducted from your balance. A session needs a balance of at least one minute to start, and may end when the balance runs out.
• Auto top-up. If you turn it on, you authorise us to charge your saved payment method the amount you choose whenever your balance falls below your threshold. You can turn it off at any time in the dashboard.
• Payments. Payments are processed by Dodo Payments, and their terms also apply to your payment. Prices exclude taxes, which are added where required.
• Refunds. Credits are non-refundable and non-transferable, except where the law requires otherwise or we agree in writing. If you think you were charged in error, contact us at support@interviewflowai.com within 30 days.

You must not use the Service, or let your users use it, to:

• impersonate a real person, or present an avatar as a real, identifiable person, without their consent;
• deceive people in harmful ways, including fraud, scams, phishing, or misleading political or election content;
• create sexual content, content that sexualises minors, or content that harasses, threatens, defames or discriminates against anyone;
• break any law, including laws on privacy, consumer protection and the disclosure of AI;
• send audio you don't have the rights or consents to use;
• record, extract or reuse the avatars' likenesses outside the Service, or use the Service or its output to build or train a competing avatar or face model;
• reverse engineer, scrape or overload the Service, get around its limits or billing, or access it other than through the API and dashboard; or
• resell raw access to the API as a standalone avatar service without our written permission.

Where the law requires it, and whenever people might otherwise be misled, tell your users that they are talking to an AI. We may suspend use that we reasonably believe breaks these rules.

You keep all rights to the audio and other content you send through the Service ("Your Content"). You give us permission to process Your Content only to provide the Service to you. We do not store or record audio or video from API sessions, and we do not use Your Content to train models. You are responsible for Your Content and for your users' use of your product.

The Service, the avatars (including their likenesses), our software and our brand belong to us or our licensors. While your account is in good standing, we grant you a limited, non-exclusive, non-transferable right to use the Service and to show the avatars to your users within your products through the Service. If you send us feedback, we may use it freely.

Our Privacy Policy explains how we handle personal information. If you send us personal information about your users, you are responsible for having a lawful basis and giving them any notice the law requires.

We work to keep the Service available and fast, but we do not guarantee that it will be uninterrupted or error-free, and we offer no service-level commitment unless agreed in writing. We may perform maintenance and update the Service.

You can stop using the Service and ask us to close your account at any time. We may suspend or close your account if you break these terms, if your use creates risk or legal exposure for us or others, or if we discontinue the Service (with reasonable notice where we can). Sections that by their nature should survive, including payment obligations, disclaimers, limitation of liability and indemnity, survive termination.

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. AI-generated output can be inaccurate or unexpected; you are responsible for how you use it.

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the six (6) months before the event giving rise to the claim.

You will defend and indemnify us against third-party claims arising from Your Content, your product, your users' use of it, or your breach of these terms or the law.

These terms are governed by the laws of the Republic of India. Any dispute will first be discussed in good faith; if it is not resolved within 30 days, it will be settled by binding arbitration under the Arbitration and Conciliation Act, 1996, and the courts in India have jurisdiction over any matter not subject to arbitration.

We may update these terms. We will change the date at the top and give account holders at least 30 days' notice by email of changes that reduce their rights. Continuing to use the Service after a change takes effect means you accept it.
